Title V permits are also known as Part 70 permits, since the applicable regulations are listed in the Code of Federal Regulations at 40 CFR part 70.

Title V Permitting Costs

Title V permitting costs and fees from regulatory authorities are designed to recover the costs of the permitting program and are authorized by federal law.  They are designed so that higher fees are paid by facilities that emit greater quantities of air pollution.

Time Required

For any permitting authority, federal regulations indicate that all Title V permits must be issued withing 3 years of the effective date of that agency's Title V program.  Most agencies are behind schedule, and issuance of a given Title V permit may be delayed if the EPA, on its own initiative or by public request, raises an objection to a permit.  This means that circumstances beyond an applicant's control may increase the time it takes to get a Title V permit.
