Non Attainment Area (NAA) Permits
NAA Applicability
| There are two stationary source definitions for nonattainment major
source permitting: a "plantwide" definition and a "dual" source
definition. The permit application must use, and be reviewed according to, whichever of
the two definitions is used to define a stationary source in the applicable SIP. |
The requirements of the NAA regulations have applicability to:
- Plantwide Stationary Source Definition
- New Major Stationary Source
- Any source type that belongs to a list of 28 Source Grouping Categories
- Has the potential to emit 100 or more tons of a regulated pollutant per year
- Any source type not listed in the 28 Source Grouping Categories
- Emits 250 or more tons of a regulated pollutant per year
- Includes all pollutant emitting activities belonging to the same industrial
grouping
- Located on contiguous or adjacent properties
- Under common control
- Major Modification of a Stationary Source
- Increases net emissions of a criteria pollutant for which the area has been
designated non attainment
- Physical change
- Change in the method of operation
- Dual Source Definition
- A Building, Structure, or Facility
- Belongs to the same industrial grouping code
- Same 2 digit Standard Industrial Classification (SIC) code
- Located on one or more adjacent properties
- Under the control of the same owner or operator
- An Installation
- An identifiable piece of process equipment
- Affected Sources Located in a Non Attainment Area
- An area formally designated as non attainment for a criteria pollutant
- Criteria pollutants - any air pollutant for which a national ambient air
standard exists
- Sources that emit Pollutants that are subject to NAA
- A source's location may be attainment or unclassified for some pollutants and
non attainment for others.
- If the proposed project only emits pollutants for which the area has been
designated attainment or unclassified, NAA would not apply.
- New Major Stationary Sources
- Emits, or potential to emit, major amounts of a criteria pollutant for which the
area has been designated non attainment.
- Major Modifications to Stationary Sources
- Plantwide Definition - Results in a significant net increase of a criteria
pollutant for which the area has been designated non attainment.
- Dual Definition - Results in a major increase in a pollutant
- for which the source is major
- for which the area has been designated non attainment
No new source or modification subject to NAA regulation may be constructed
without a permit.
